What are trademarks, who protects them, and what about those symbols?
- A trademark is a sign that serves to distinguish goods and services. In other words, a trademark makes it clear that a good or service comes from your company and not from another. Legally, a trademark differs from a trade name (which serves to distinguish your business from that of another) and from a company name (your BV, your NV), but it is of course possible for the same sign to fulfill all three functions.
- There is no such thing as a Belgian trademark. You need to go for a Benelux trademark right away. If you have European ambitions, you might want to consider an EU trademark. But you can also apply for trademarks outside the Benelux and the EU. Without registration, you will not enjoy trademark protection in the Benelux and the EU. For trademark registration, you can contact the BOIP (Benelux) and the EUIPO (EU), but it is best to work with trademark agencies that will check in advance whether the sign you want to register is already registered (to avoid discussions in advance) and that can advise you on how to make your trademark registration as strong as possible.
- In the EU, the use of the ® and TM symbols is not mandatory. In the US, this is different.
The difference with copyright
- Copyright protects original creations of the mind, ranging from literary and scientific texts, photographs, designs of objects, and paintings to the branding of a trademark. With copyright ©, you must ask the owner for permission if you want to use their work.
Why protect your brand with a registered trademark?
Legal protection: A trademark registration provides legal protection and exclusive rights to use your brand name, logo, or slogan. This means other companies cannot use a similar brand that could cause confusion among consumers. If your brand is not registered, you risk others exploiting your reputation, potentially leading to customer confusion and diminishing the value of your brand.
Preventing brand confusion: An original design ensures your brand to stand out within your industry, allowing customers to clearly distinguish your products or services from those of competitors. This is one of the key benefits of strong branding. Brand confusion can be harmful, as it may mislead consumers and undermine trust in your brand. Trademark registration helps prevent infringement by others and avoids confusion in the marketplace.
Creating brand value: A registered trademark represents a valuable business asset. As your brand grows in recognition and builds positive associations with consumers, its value increases accordingly. A strong, well-known brand can significantly impact the growth and profitability of your business. Investors and potential partners often view a registered trademark as a sign of professionalism and long-term commitment, making them more likely to collaborate with your company.
Easier expansion into new markets: With a registered trademark, you can protect your brand name and identity across multiple geographic regions. If you plan to expand internationally in the future, trademark registration is essential. It prevents other companies in new markets from claiming your brand name before you enter that market yourself.
