  • There is no such thing as a Belgian trademark. You need to go for a Benelux trademark right away. If you have European ambitions, you might want to consider an EU trademark. But you can also apply for trademarks outside the Benelux and the EU. Without registration, you will not enjoy trademark protection in the Benelux and the EU. For trademark registration, you can contact the BOIP (Benelux) and the EUIPO (EU), but it is best to work with trademark agencies that will check in advance whether the sign you want to register is already registered (to avoid discussions in advance) and that can advise you on how to make your trademark registration as strong as possible.
  • In the EU, the use of the ® and TM symbols is not mandatory. In the US, this is different.

The difference with copyright

  • Copyright protects original creations of the mind, ranging from literary and scientific texts, photographs, designs of objects, and paintings to the branding of a trademark. With copyright ©, you must ask the owner for permission if you want to use their work.

This means other companies cannot use a similar brand that could cause confusion among consumers.
